GOVERNMENT BUSINESS

 

RESOLUTION

 

            A MINISTER to move that the requirement of sub-rule (2) of Rule 115 of the Rules of Procedure of the Provincial Assembly of the Punjab 1997 be suspended under rule 234 of the Rules ibid, for moving of the Resolution demanding the President of Pakistan to obtain vote of confidence from the electoral college or resign from his office or to call upon the Parliament to give Notice for his impeachment.

 

            A MINISTER to move the following Resolution:-

 

                  “The Punjab Assembly observes:

                  1.   That under Article 41 of the Constitution of the Islamic Republic of Pakistan, the Punjab Assembly is a part of the electoral college for the election of the Office of the President of Pakistan.

                  2.   That notwithstanding the Punjab Assembly’s objection to the validity or legality of the elections held in October, 2007 for the office of the President of Pakistan, the Punjab Assembly is of the view:

 

                  That General (Retd.) Pervez Musharraf is unfit to hold the office of the President by virtue of being guilty of violating the Constitution of Pakistan and/or of gross misconduct on the following, amongst other, grounds:

                      i)   That General (Retd.) Pervez Musharraf has subverted the Constitution of the Islamic Republic of Pakistan twice by holding it in abeyance.

                     ii)   He has violated and undermined the Constitution of the Islamic Republic of Pakistan and derailed the transition to democracy.

                    iii)   That in terms of Article 41(1) of the Constitution, the office of the President represents the unity of the Republic. General (Retd.) Pervez Musharraf has violated the same and has caused to promote inter provincial tension, a deepened sense of deprivation, denied provincial autonomy thus leading to weakening the Federation.

                    iv)   That the policies pursued by General (Retd.) Pervez Musharraf during the last 8 years have brought to the brink of a critical political and economic impasse. The incompetence and failure of his policies has plunged the country into the worst power shortage in its history and brought unprecedented misery upon the people. His policies have paralyzed the Federation and eroded the trust of the Nation in key National Institutions.

 

                  In the light of the above, we hereby call upon General (Retd.) Pervez Musharraf to take a vote of confidence from his electoral college or resign in terms of Article 44(3) of the Constitution of the Islamic Republic of Pakistan immediately. In case he fails to do so, we call upon and urge the Parliament to give Notice of impeachment in accordance with Article 47 of the Constitution.”

Rana Muhammad Iqbal Khan, Speaker Provincial Assembly of the Punjab assumed the Chair and proceedings commenced with recitation from the Holy Qur’an followed by its Urdu translation by Qari Muhammad Ali Qadri. Assembly employee Maqbool Hussain recited Naat-e- Rasool Maqbool (PBUH).

 

Oath:-

Mian Shahid Hussain Bhatti, member-elect from PP-107 (Hafizabad) made oath as Member of the Punjab Assembly and signed the Roll of Members. The Speaker administered the oath.

The rules were suspended under the sub-rule (2) of Rule 115 of the Rules of Procedure of the Provincial Assembly of the Punjab 1997 under rule 234 of the rules ibid, the Minister for Law and Parliamentary Affairs Rana Sanaullah Khan moved the following resolution.

 

The Punjab Assembly observes:

In the light of the above, we hereby call upon General (Retd.) Pervez Musharraf to take a vote of confidence from his electoral college or resign in terms of Article 44(3) of the Constitution of the Islamic Republic of Pakistan immediately. In case he fails to do so, we call upon and urge the Parliament to give Notice of impeachment in accordance with Article 47 of the Constitution.

 

The resolution was supported by PML-N, PPP, PML-F, PML-Q (Forward bloc) and JUI members. The majority legislators allowed the Speaker to suspend Assembly rules for tabling the resolution. The leader of the Opposition Ch. Zahir-ud-Din and other Opposition Members, Muhammad Mohsin Khan Leghari, Muhammad Ejaz Shafi and Amna Ulfat pleaded against suspending rules and contended that there was no emergency calling for suspension of rules to table a resolution. The motion was passed by the majority of Members to move the resolution. The Law Minister moved the resolution which was opposed by the Opposition Members who made speeches on it. After that the resolution was voted upon and was passed by overwhelming majority of 321 Members and was opposed by 25 Members.

 

Later, the quorum was pointed out and the House was then adjourned till 10:00 a.m, Tuesday, 12 August, 2008.
