GOVERNMENT BUSINESS

 

(A) INTRODUCTION OF BILLS

 

1.   THE PUNJAB SERVICE TRIBUNALS (AMENDMENT) BILL 2012

            A MINISTER to introduce the Punjab Service Tribunals (Amendment) Bill 2012.

 

2.   THE PUNJAB LOCAL GOVERNMENT (FOURTH AMENDMENT) BILL 2012

            A MINISTER to introduce the Punjab Local Government (Fourth Amendment) Bill 2012

 

(B) LAYING OF ORDINANCE

 

      THE PUNJAB TRANSPLANTATION OF HUMAN ORGANS AND TISSUES ORDINANCE 2012

            A MINISTER to lay the Punjab Transplantation of Human Organs and Tissues Ordinance 2012.

 

(C) RECONSIDERATION AND PASSAGE OF BILLS

 

1.   THE INFORMATION TECHNOLOGY UNIVERSITY OF THE PUNJAB BILL 2012 (Bill No.18 of 2012)

 

(a)       A MINISTER to move that the message of the Governor in respect of the Information Technology University of the Punjab Bill 2012, as passed by the Assembly on 18 July 2012, be taken into consideration at once.

(b)       A MINISTER to move that the Information Technology University of the Punjab Bill 2012, as originally passed by the Assembly and returned by the Governor under Article 116(2)(b) of the Constitution, be reconsidered in the light of the message of the Governor.

(c)        A MINISTER to move that in clause 9 of the Bill–

                  (a) in sub-clause (1), for the words “Chief Minister”, the word “Governor” shall be substituted.

                  (b) after sub-clause (3), the following new sub-clause (4) shall be inserted:-

“(4)      In the performance of all the functions under this Act, the Chancellor shall act and shall be bound in the same manner as the Governor of a Province acts and is bound under clause (1) of Article 105 of the Constitution of the Islamic Republic of Pakistan.”

 (d)      A MINISTER to move that in clause 10 of the Bill, after sub-clause (3), the following new sub-clause (4) shall be inserted:-

                   “(4)  The Chancellor may set aside a decision or action of the Syndicate, which, in the opinion of the Chancellor, is against the law, interest of academic excellence of the University, religious or cultural ideology, or national integrity.”

(e)       A MINISTER to move that in clause 31 of the Bill, after sub-clause (2), the following new sub-clause (3) shall be inserted:-

               “(3)  The Syndicate shall recommend statutes under clauses (a) and (b) of subsection (2) to the Chancellor who may approve the statutes with or without any modification or may refer the statutes back to the Syndicate for reconsideration or may reject the statutes.”

(f)        A MINISTER to move that after clause 35 of the Bill, the following new clause 36 shall be inserted and the subsequent clauses be renumbered accordingly:-

                   36. Resident Auditor.– The Government shall appoint, on deputation, an appropriate officer of the Government as the Resident Auditor of the University.”

(g)       A MINISTER to move that the Information Technology University of the Punjab Bill 2012, as amended, be passed again.

 

2.   THE PUNJAB GOVERNMENT SERVANTS HOUSING FOUNDATION (SECOND AMENDMENT) BILL 2011 (Bill No. 11 of 2012)

            A MINISTER to move that the message of the Governor in respect of the Punjab Government Servants Housing Foundation (Second Amendment) Bill 2012, as passed by the Assembly on 18 July 2012, be taken into consideration at once.

            A MINISTER to move that the Punjab Government Servants Housing Foundation (Second Amendment) Bill 2012, as originally passed by the Assembly and returned by the Governor under Article 116(2)(b) of the Constitution, be reconsidered in the light of the message of the Governor.

                A MINISTER to move that the Punjab Government Servants Housing Foundation (Second Amendment) Bill 2012, as originally passed by the Assembly be passed again.

 

(D) MOTION UNDER RULE 244-A

 

      MOTION UNDER RULE 244-A OF THE RULES OF PROCEDURE OF THE PROVINCIAL ASSEMBLY OF THE PUNJAB 1997

 

            A MINISTER to move that leave be granted to move the proposed amendment in sub-rule (1) of Rule 148 of the Rules of Procedure of the Provincial Assembly of the Punjab 1997.

            A MINISTER to move that the proposed amendment in sub-rule (1) of Rule 148 of the Rules of Procedure of the Provincial Assembly of the Punjab 1997 be taken into consideration at once.

            A MINISTER to move that the proposed amendment in sub-rule (1) of Rule 148 of the Rules of Procedure of the Provincial Assembly of the Punjab 1997 be passed.

 

            Note:  The proposed amendment is given in the Annexure.

 

(E) CONSIDERATION AND PASSAGE OF BILLS

1.   THE WOMEN UNIVERSITY MULTAN (AMENDMENT) BILL 2012 (Bill No.12 of 2012)

 

            A MINISTER to move that the Women University Multan (Amendment) Bill 2012, as recommended by the Standing Committee on Education, be taken into consideration at once.

            A MINISTER to move that the Women University Multan (Amendment) Bill 2012 be passed.

 

2.    THE PUBLIC SECTOR UNIVERSITIES (AMENDMENT) BILL 2012 (Bill No.13 of 2012)

 

            A MINISTER to move that the Public Sector Universities (Amendment) Bill 2012, as recommended by the Standing Committee on Education, be taken into consideration at once.

            A MINISTER to move that the Public Sector Universities (Amendment) Bill 2012 be passed.

 

3.   THE UNIVERSITY OF VETERINARY & ANIMAL SCIENCES, LAHORE (AMENDMENT) BILL 2012 (Bill No.15 of 2012)

 

                A MINISTER to move that the University of Veterinary & Animal Sciences, Lahore (Amendment) Bill 2012, as recommended by the Standing Committee on Livestock and Dairy Development, be taken into consideration at once.

            A MINISTER to move that the University of Veterinary & Animal Sciences, Lahore (Amendment) Bill 2012 be passed.

Rana Muhammad Iqbal Khan, Speaker, assumed the Chair and proceedings commenced with a recitation from the Holy Qur’an and its Urdu translation followed by Naat-e-Rasool-e-Maqbool (PBUH).

Question Hour:-

Questions relating to Communications and Works Department were asked and answered by Malik Ahmad Ali Aulakh, Minister for Agriculture (holding additional charge).

Laying of Report:-

Ch. Ghulam Nabi presented the report of Standing Committee on Transport before the House in respect of “The Punjab Metro Bus Authority Bill 2012 (Bill No. 27 of 2012)”.

Government Business:-

Bills:-

Minister for Law and Parliamentary Affairs, Rana Sanaullah Khan introduced the following Bills before the House which were referred to the concerned Standing Committees for report within one month.

(1)       THE PUNJAB SERVICE TRIBUNALS (AMENDMENT) BILL 2012” ,     

(2)       THE PUNJAB LOCAL GOVERNMENT (FOURTH AMENDMENT) BILL 2012”

Minister for Law and Parliamentary Affairs laid the following Bill before the House under Rule 91(6) of the Rules of Procedure of the Provincial Assembly of the Punjab 1997, which was referred to the Standing Committee on Health for report within one month.

THE PUNJAB TRANSPLANTATION OF HUMAN ORGANS AND TISSUES ORDINANCE” 2012,

Minister for Law and Parliamentary Affairs moved the following Bill which was originally passed by the Provincial Assembly of the Punjab and returned by the Governor under Article 116(2)(b) of the Constitution and was again passed by the House as amended “THE INFORMATION TECHNOLOGY UNIVERSITY OF THE PUNJAB BILL 2012 (Bill No.18 of 2012)”.

Suspension of Rules

On a motion moved by Minister for Law and Parliamentary Affairs under Rule 234 of the Rules of Procedure of the Provincial Assembly of the Punjab, the House granted leave to suspend Rule 127 (2) of the Rules ibid, for taking up the Resolutions under Article 144 (1) of the Constitution of the Islamic Republic of Pakistan.

Resolution:-

Minister for Law and Parliamentary Affairs moved a Resolution rejecting the Commission for the creation of new Provinces constituted by Speaker National Assembly. It stated that the House considers the Commission contrary to the spirit of the Resolution passed on 8 May 2012 by the House and it was also against the solidarity of the country and demanded the Federal Government to withdraw the Commission immediately and form a National Commission by taking all the stake holders on board keeping in view the constitutional requirements. The Resolution was passed by the House.

"صوبائی اسمبلی پنجاب کا یہ نمائندہ ایوان، نئے صوبوں کے قیام کے حوالے سے سپیکر قومی اسمبلی کی جانب سے 16۔اگست2012 کو نامزد کردہ کمیشن کو مسترد کرتا ہے۔ اس ایوان کی رائے ہے کہ مذکورہ کمیشن، صوبائی اسمبلی پنجاب کی 9۔مئی2012 کو منظور کردہ قراردادوں کی روح اور مندرجات کے برعکس ہے اور وفاق پاکستان کی سالمیت کے تقاضوں سے متصادم ہے۔

یہ ایوان وفاقی حکومت سے اس امر کا مطالبہ کرتا ہے کہ مجوزہ کمیشن کو فی الفور withdraw کیا جائے اور تمام سٹیک ہولڈرز کو اعتماد میں لیتے ہوئے قومی اتفاق رائے اور آئینی تقاضوں کو ملحوظ خاطر رکھتے ہوئے ایسا نمائندہ قومی کمیشن تشکیل دیا جائے جس پر تمام قومی/صوبائی قیادتوں کو اعتماد ہو۔"
