 Sardar Sher Ali Gorchani, Acting Speaker, assumed the Chair and proceedings commenced with a recitation from the Holy Qur’an and its Urdu translation followed by Naat-e-Rasool-e-Maqbool (PBUH).

Oath: −

Mr. Muhammad Khan, Member-elect from Jhang (PP-81) made an oath and signed the Roll of Members. The Acting Speaker administered the oath and congratulated him on becoming MPA.

Question Hour: −  

Questions relating to Schools Education Department were asked and Rana Mashhood Ahmad Khan, Minister for School Education answered the questions.

Laying of Report:-

Mr. Nishat Ahmad Khan Daha presented the report of the Standing Committee on Health before the House in respect of “The Punjab Reproductive, Maternal, Neo-Natal and Child Health Authority Bill 2014 (Bill No. 12 of 2014)”.

Ruling of the Speaker:-

During the sitting of the Assembly held on Tuesday, December 10, 2013, Mr Khalil Tahir Sindhu, Minister for Human Rights and Minority Affairs was presenting the viewpoint of the Government on the Adjournment Motions moved by the hon’able Members of the Assembly. Sheikh Ala-ud-Din, MPA (PP-181), on a point of order, contended that the replies to the Adjournment Motions should be given by the concerned Minister and, in his absence, by the Law Minister and not by any other Minister. The Hon’ble Acting Speaker Sardar Sher Ali Gorchani, promised to look into the matter and would give ruling later on. In his ruling, he contended that “Rule 80 of the Rules of Procedure of Provincial Assembly of the Punjab, 1997 governs the initial stage of the Adjournment Motion and gives the power to Speaker to allow a mover to move his Adjournment Motion in the House. Rule 85 lays down the procedure for admitting a motion for discussion. In neither of the two Rules, there is any provision for the role of the Government or the concerned Minister. It is the House which gives grants (or withholds) the leave only “if the Speaker is of the opinion that the matter proposed to be discussed is in order”. If members not less than one-sixth of the total membership of the Assembly so rise, the Speaker shall announce that leave is granted and the motion shall be taken up for discussion in the same session for not more than two hours on such day, as soon as possible, within three days after the leave is granted, as the Speaker may fix. The role of the Government or the concerned Minister comes into action on the day fixed by the Speaker for discussion of the Adjournment Motion. The prevalent practice of taking Government stance at the time of moving of the Adjournment Motion is just in order to facilitate the Chair and the House for granting of the leave and not as a matter of right of the mover or requirement of the Rules.”

The point of order raised by Sheikh Ala-ud-Din, MPA (PP-181) is disposed of accordingly.         

Privilege Motions:-

Four Privilege Motions were taken up. The Motion moved by Pir Khizer Hayat Shah Khagga regarding misbehaviour of Mr. Farukkh, SHO, Ghallah Mandi, Sahiwal with the Member concerned was kept pending till Friday. The Motion of Sheikh Ala-ud-Din regarding a column by Dr. Safdar Mehmood in daily “Jang” using derogatory remarks about Members of Provincial Assembly of the Punjab and the other Motion of Rana Tahir Shabbir regarding misbehaviour of Mr. Shahid Mehmood, EDO, Education, Multan with the Member concerned were kept pending till next session. The last Motion moved by Mr. Najeeb Ullah Khan Niazi regarding misbehaviour of Mr. Gull Noor, DFO, Bhakkar with the Member concerned was referred to the Privileges Committee with the direction to submit its report within one month.

The Motions were answered by Rana Sana Ullah Khan, Minister for Law & Parliamentary Affairs.

Adjournment Motions:-

Four Adjournment Motions were taken up. The Motion moved by Ms Shunila Ruth regarding dangerous increase in car snatching incidents in Lahore and the car snatchers flee after leaving the owners/drivers of cars in remote areas of other districts, the Motion moved by Ms Nighat Sheikh regarding making laws to curb dowry and its related maladies, the Motion of Sardar Vickas Hassan Mokal regarding illegal bus stand established at the land of Auqaf Department, Sargodha Zone, in connivance with its staff and land mafia and bringing loss of million of rupees to the department and the last Motion of Mr. Ahmad Shah Khagga regarding shortage of graves in the graveyards in the suburbs of Chauburji to Yateemkhana residential areas were disposed of.

The Motions were answered by Ch. Nazar Hussain, Parliamentary Secretary for Law & Parliamentary Affairs.

Pre-Budget Discussion:-

Pre-Budget discussion continued for the second day. The following Members participated in the discussion: Sheikh Ijaz Ahmad, Rana Muhammad Arshad, Dr. Najma Afzal Khan, Syed Muhammad Sibtain Raza, Mrs. Shameela Aslam and Rana Munawar Hussain alias Rana Munawar Ghous.

The House was then adjourned till 10:00 a.m on Wednesday, 20th March, 2014.
