1.   CONDOLENCE RESOLUTION

 

 

            A MINISTER to move that the requirement of Rule 115 of the Rules of Procedure of the Provincial Assembly of the Punjab 1997 be suspended under rule 234 ibid, for taking up the condolence resolution on the sad demise of Mr Zahoor Ahmad Khan Daha, Member, Provincial Assembly of the Punjab/Parliamentary Secretary for Finance.

2.   THE PUNJAB CONSUMER PROTECTION (AMENDMENT) BILL 2006 (Bill No.18 of 2006)

 

 

            A MINISTER to move that the Punjab Consumer Protection (Amendment) Bill 2006, as recommended by Standing Committee on Industries, be taken into consideration at once.

 

 

            A MINISTER to move that the Punjab Consumer Protection (Amendment) Bill 2006, be passed.

 

 

 

 

3.   THE PUNJAB DEVELOPMENT OF CITIES (AMENDMENT) BILL 2006 (Bill No.20 of 2006)

 

 

            A MINISTER to move that the Punjab Development of Cities (Amendment) Bill 2006, as recommended by Standing Committee on Housing, Urban Development and Public Health Engineering, be taken into consideration at once.

 

 

            A MINISTER to move that the Punjab Development of Cities (Amendment) Bill 2006 be passed.

 

 

4.   THE UNIVERSITY OF AGRICULTURE , FAISALABAD (AMENDMENT) BILL 2006 (Bill No.14 of 2006)

 

 

            A MINISTER to move that the University of Agriculture, Faisalabad (Amendment) Bill 2006, as recommended by Standing Committee on Agriculture, be taken into consideration at once.

 

 

            A MINISTER to move that the University of Agriculture , Faisalabad (Amendment) Bill 2006 be passed.

Ch. Muhammad Afzal Sahi, Speaker, assumed the chair and proceedings commenced with the recitation from the Holy Quran.

 

CONDOLENCE RESOLUTION:-

      Mr. Muhammad Basharat Raja, Minister for Law and Parliamentary Affairs, moved the following condolence resolution on the sad demise of Mr. Zahoor Ahmad Khan Daha, Parliamentary Secretary for Finance, which was unanimously adopted by the House:-

 

 

The House later offered “Fateha” for the departed soul.

 

QUESTION HOUR:-

Questions relating to REVENUE AND COLONIES (BOARD OF REVENUE) DEPARTMENTS were asked and answers were given respectively by Mr. Gul Hameed Khan Rokhri, Minister for Revenue, Relief & Consolidations and Mr. Manazir Hussain Ranjha, Minister for Colonies.

 

CALL ATTENTION NOTICES:-

The first Call Attention Notice of Mr. Abdul Rashid Bhatti was disposed of due to the absence of mover.

 

The second Notice moved by Mr. Aftab Ahmad Khan about molestation and killing of two young daughters of Mr. Muhammad Iqbal resident of Faisalabad was replied by Mr. Muhammad Basharat Raja, Minister for Law & Parliamentary Affairs and was disposed of.

 

Fateha

The House offered Fateha on the sad demise of Mr. Fazal Hussain Rahi Ex. MPA.

 

PRIVILEGE MOTIONS:-

Total two Privilege Motions were taken up. The Privilege Motion moved by Mirza Furqan Ali Mughal was kept pending till 9 October 2006, due to the absence of Mian Imran Masood, Minister for Education.

 

The Privilege Motion moved by Mr. Hafeez Ullah Khan regarding miss-behaviour of D.O., Population Welfare, District Bhakar was ruled in order and was referred to the Privilege Committee.

 

ADJOURNMENT MOTIONS:-

Total three Adjournment Motions were taken up. Out of which Adjournment Motion of Syed Ihsan Ullah Waqas was kept pending till 9 October 2006.

 

Adjournment Motion moved by Miss Zaib-un-Nisa Qureshi regarding rape and murder of 22 years old girl, Shabana in Sabzazar, Lahore was replied by Mr. Muhammad Basharat Raja, Minister for Law and Parliamentary Affairs and was disposed of.

 

Adjournment Motion moved by Mrs. Tahira Munir was about death of 22 years old, Aamir Shahzad due to police torture in the their custody at Tibbi City Police Station, Lahore. The motion was replied by Mr. Muhammad Basharat Raja, Minister for Law and Parliamentary Affairs and was disposed of.

  • The House granted extension in the time limit till 15 November 2006 on a motion moved by Mr. Muhammad Husnain Khan Bosan for laying the report of the Standing Committee for Revenue, Relief and Consolidation on “The Punjab Prohibition of Private Money Lending Bill 2003 (Bill No. 24 of 2003)” moved by Mrs. Humera Owais.

GOVERNMENT BUSINESS:-

 

Mr. Muhammad Basharat Raja, Minister for Law & Parliamentary Affairs moved

THE PUNJAB CONSUMER PROTECTION (AMENDMENT) BILL 2006 (Bill No.18 of 2006) which was considered and passed by the House. The Bill will provide a proper forum to consumers to take legal action against manufacturers and sellers. The Bill authorizes Government to establish one or more than one consumer courts in one or more than one districts.

 

POINT OF ORDER:-

During the sitting of the Punjab Assembly on 2 October 2006, Mr. Arshad Mehmood Baggu, MPA, raised a point of order that the Governor had promulgated “The Punjab Border Military Police (Amendment) Ordinance 2006” on 26 September 2006, whereas, the Governor had already issued order on 20 September 2006 summoning the Assembly to meet on 28 September 2006. He requested the Speaker to give his ruling on the point whether an Ordinance could have been promulgated by the Governor after issuing the summoning order but before the commencement of the Session. Since the point of order required interpretation of the Article 128 of the Constitution, the ruling on the point of order was reserved.

 

The Chair in his ruling explained that Article 128 read with Article 89 of the Constitution of the Islamic Republic of Pakistan, authorizes the Governor, subject to his satisfaction as to urgency, may promulgate an ordinance except when the Assembly is in session i.e., period commencing on the day of the first sitting of the Assembly after having been summoned and ending on the day the Assembly is prorogued or dissolved. The mere signing of the summoning order regarding commencement of Assembly Session by the Governor or even its notification does not originate the session prior to the date fixed for the purpose by the Governor.

 

The Governor, by his order dated 20 September 2006, summoned the Assembly to meet on 28 September 2006; and, signed “the Punjab Border Military Police (Amendment) Ordinance 2006 (XV of 2006)” on 26 September 2006, when the session of the Assembly had not yet started.

 

Since the Assembly was not in session when the Ordinance was promulgated on 26 September 2006, no violation of the Constitution was involved, thus the point of order was disposed of.  

 

The House was then adjourned till 9:00 am on Friday, 6 October, 2006.
